Brian J Palmeri and Meghan Daley of Winget, Spadafora & Schwartzberg LLP’s Connecticut office secured a defense verdict in favor of the firm’s clients in a FINRA Dispute Resolution arbitration. The Claimant alleged that the representatives and broker-dealer violated their fiduciary duties to Claimant related to a withdrawal from a joint securities account Claimant maintained with his ex-wife, a well-known television and social media personality. Claimant also alleged negligence and misrepresentation with respect to the withdrawal and the handling of the account. The Claimant sought damages in the amount of approximately $413,000, as well as attorney’s fees and punitive damages. After four days of arbitration hearings, the Panel dismissed the claims in their entirety.
