Wayne is a Partner in the Los Angeles office of Winget, Spadafora & Schwartzberg, LLP. For over two decades, Wayne has been a trial attorney with a focus in professional liability, employment, complex commercial and business litigation, general liability, catastrophic injury, insurance bad faith, coverage matters, and construction defect matters. Wayne has assisted clients in state and federal courts all across the country in cases through trial. In addition to Wayne’s outstanding trial results, Wayne prides himself in providing sound and strategic advice to help clients analyze risk and efficiently resolve claims when possible.
Representative Decisions
Certain Underwriters at Lloyds, London v. AEG Live and The Michael Jackson Company, LLC
Rescission litigation under a contingency cancellation policy for the “This Is It” concerts in London. The matter was litigated following Jackson’s death as to the issue of material misrepresentations and non-disclosures in the application for insurance. After more than a year of litigation, AEG dropped its $17.5 million insurance claim for a waiver of costs. Litigation continued and was resolved with the Jackson Estate.
Defense verdict in premises liability matter with claimed damages of $1.5 million
Obtained Summary Judgement in assault and battery claim in defense of large corporation
Represented various corporate entities and individuals in matters involving insurance coverage and bad faith issues, general liability, professional liability, and employment matters.
Professional liability defense experience includes the defense of doctors, hospitals, attorneys, land surveyors, architects, and insurance brokers and agents.
