On September 10, the U.S. Court of Appeals for the Fifth Circuit affirmed a trial court victory in a legal malpractice case obtained by WSSLLP Houston Managing Partner Martin Schexnayder. The case, which involved issues of conflict of interest and breach of fiduciary duty against a national employment law firm, was tried before Hon. Al Bennett of the U.S. District Court for the Southern District of Texas in January 2019. After several days of testimony, Judge Bennett rendered judgment in favor of the law firm, finding no breach of fiduciary duty or other actionable conduct and denying the plaintiff’s claim for damages. On appeal, the Fifth Circuit court appeals affirmed the judgment. WSSLLP congratulates Martin Schexnayder and the firm’s client for this favorable result.
